General conditions of sale

These conditions that regulate the purchase contracts made in the online store www.squaliswim.com, for which SQUALI SWIM SL is legally responsible, with CIF No. B-67929513 and address in Madrid, C/ Aguacate 29, (28044 Madrid), email: squali@squaliswim.com, hereinafter "Squali Swim", will become part of the contract when Squali Swim confirms the business relationship by sending the consumer written proof of the contract with all its terms and are accepted by the consumer.

Purchasing process

In order to make purchases on the website www.squaliswim.com you must accept the general conditions of sale. The mere use of the services of squaliswim.com implies acceptance of these conditions.

The purchasing process is as follows:

1. - Access the purchase section within the website

You must access the website www.squaliswim.com/tienda

2- Product selection

Once inside the store section you will be able to see all the available items.

Simply select the item you want, choose the color, size and quantity you want, then click the “Add to cart” button. The price indicated for each product is in Euros and does not include shipping costs.

At the top right of the page you will see the shopping cart with the product selection you have made.

During the purchasing process you have the possibility to modify the contents of the cart. You can remove items, add new ones or modify the requested quantity.

3- How to remove one or more items from the cart

On the left side of each line of items you will find an x, and you will simply have to click on each of the items you wish to delete and the amount of your purchase will be updated.

4- How to modify the quantity of an item

In the quantities section you can enter the new amount, and the amount of your purchase will be automatically updated.

5- How to add a new product to the cart

You can always select a new item and add it to your basket by clicking “Add to cart”.

6- How to choose an address

On the screen that you will see after confirming the items you wish to purchase, a form will appear for you to enter the address where you wish us to send your order.

Due to delivery requirements, PO Boxes are not accepted as recipient addresses.

We will default to the billing information you entered on the form.

7- Make the payment

The only payment method available at Squali Swim is by debit or credit card.

Once you click on the option to make the payment, you will be asked to enter your credit or debit card details.

Payment by credit or debit card is made through the bank's secure payment gateway. Through this payment method, Squali Swim never collects or manipulates any customer data related to their card number. All data is processed directly by the bank, so that Justino Delgado can always offer the greatest security, transparency and confidentiality in the transaction.

Legislation

These conditions of sale shall be executed and interpreted in accordance with Spanish law, to which the parties expressly submit. Any dispute that may arise from its validity, interpretation or execution shall be submitted to the Spanish courts.

Shipping

1. Delivery methods

The shipping companies used by Squali Swim are Tipsa and Correos.

2. Order delivery times

The estimated delivery time for Squali Swim orders is 48 hours.

Once your order leaves our warehouse you will receive a notification message in your email.

In the event that squaliswim.com cannot meet this deadline, the customer may proceed to confirm, change or cancel the order in part or in full. If the customer opts for total cancellation, the full amount paid will be refunded within a maximum of three working days.

Squali Swim reserves the right to make partial shipments, without any additional charge for the customer.

The transit time, the time elapsed since the order leaves our warehouses until delivery, is established as one (mainland Spain) two days.

Squali Swim only ships domestically.

Shipments will be made to:

• Peninsular Spain

• Balearic Islands

• Canary Islands

• Ceuta and Melilla

Squali Swim cannot be held responsible for failure to comply with these deadlines in the event of force majeure, such as a total or partial strike (particularly involving means of transport), or other similar causes.

3. Shipping costs

Rates for each zone will be calculated based on the geographic location of the recipient and the weight/volume of the total items purchased. Shipping costs are shown separately from the item price and do not include taxes, which will be calculated separately if applicable.

When all the items in your basket are confirmed, the online store automatically calculates the shipping costs. If you modify the items in your basket or change the destination of your order, the shipping costs may vary.

The transport companies usually used in our shipments are:

Peninsular Spain: Tipsa/Correos

Spain Balearic Islands: Tipsa/Correos

Spain Canary Islands, Ceuta and Melilla: Tipsa/Correos

Squali Swim reserves the right to change the transport agency, without this implying an exceptional expense for the client or affecting the delivery conditions of their order.

4. Customs and taxes

Deliveries only in Spain

The prices of the products for sale in the online store include 21% VAT (items and shipping costs).

Orders destined for the Canary Islands, Ceuta and Melilla are subject to various customs fees and taxes specific to their Autonomous Community. Payment of these, if applicable, will be the responsibility of the customer and will be paid at the time of delivery of the goods.

5. Precautions at the time of delivery

It is the recipient's responsibility to check the shipments upon arrival, recording in writing at the time of delivery any observations and complaints that he or she deems justified (including rejecting the package) if he or she finds that the package is likely to have been opened or shows clear signs of deterioration. These observations must be communicated to turboswim.com as soon as possible.

6. Exchanges and returns

Any item purchased at www.squaliswim.com has a full satisfaction guarantee.

If you are not satisfied with your purchase, you can return part or all of the order, giving notice within 15 calendar days of receiving the goods. Once we receive the product and confirm its good condition, we will refund the amount of the item but not the shipping costs paid for the order.

If you wish to change the size, colour or model of the purchased item, a new delivery with return will be made for a fee of €6.95 including taxes. This process will be effective as long as it is proven that the order is in perfect condition. Returns are usually made by Tipsa, if you choose another method you will have to pay all costs.

If you wish to make any changes or returns, you will have to pay the shipping costs of €6.95.

In the case of defective products or products that do not correspond to the order placed by the customer, we will assume all costs arising from the exchange and subsequent shipment of the correct order. Upon receipt of the package, we will confirm that the product is in good condition and that it was indeed an error on our part. The new product will then be shipped.

Under no circumstances will the exchange or return of items that have been used, manipulated by the customer or that do not arrive in their original packaging be accepted. Returns with postage due or cash on delivery will also not be accepted.

Wear or deterioration caused by use, misuse or the passage of time will not be grounds for exchange.

Once the package has been received in our warehouses and the contents have been inspected, we will proceed according to the instructions indicated on the return form.

No changes will be accepted without prior authorization from Squali Swim .

For hygiene reasons, swimsuits must be tried on with underwear.

7. Custom Orders for Equipment.

The policy mentioned in the previous paragraphs applies solely and exclusively to any order from the Squali Swim collection.

Custom orders for equipment are made on demand and are only manufactured and shipped for the person who placed the order, therefore returns are not accepted unless the product arrives in poor condition or is defective. The customer will have 15 days from receipt of the product to check its condition and notify Squali Swim.

Once verified, a new order will be processed for the customer at no additional cost. Under no circumstances will the amount of the original order be refunded.

Returns are not accepted for the following reasons:

a. Error when ordering a product or choosing a size . It is understood that the customer has previously obtained information about which product and which size to choose. Both your own sports entity and Squali Swim will make every effort to ensure that the type of product and size being purchased is clear before making the purchase. If the customer is unsure, they may consult Squali Swim or the person in charge of their team.

b. Delays in shipping times . Depending on the type of product, shipping times may vary between 4-8 weeks. It may be the case that due to specific times of the year in production, the order placed may be delayed. The customer will be notified that the order will be delayed, but in no case will this be grounds for a refund.

c. Any other reason not included in the previous assumptions.

Contents and information provided

Squali Swim reserves the right to modify the commercial offer presented on the Website (modifications on products, prices, promotions and other commercial and service conditions) at any time.

We make every effort to provide the information contained on the website in a truthful manner and without typographical errors. In the event that at any time an error of this type occurs, which is at all times beyond the control of turboswim.com, it will be immediately corrected. If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on said error, we will inform the customer of said error and they will have the right to cancel their purchase without any cost on their part.

The website www.squaliswim.com, as well as the emails you receive from Squali Swim contain copyrighted material. You agree that you do not acquire ownership of this copyrighted material by merely downloading copyrighted information from the website. Squali Swim is the owner and holds ownership in the selection, coordination, arrangement and modification of the content published on the website, as well as in its originals.
